If you’re enrolled in a Medicare Supplement (Medigap) plan, it’s easy to assume you’re locked into your current coverage unless you’re willing to go through medical underwriting. For many people, that assumption is enough to keep them from exploring other options—even as their premiums rise or their needs change over time.
But in some states, there’s a little-known rule that opens the door to more flexibility. Once a year, during a short window tied to your birthday, you may be able to switch to a new Medigap plan without answering health questions or worrying about being denied for pre-existing conditions.
It’s called the Birthday Rule, and for those who qualify, it’s one of the most overlooked opportunities to lower costs and find a plan that’s a better fit.
What Is the Birthday Rule?
The Birthday Rule allows people enrolled in Medigap plans to switch to a plan with equal or lesser benefits without medical underwriting, just because it’s their birthday.
This means you can:
- Shop for a lower premium
- Change insurance carriers
- Switch to a more affordable plan
- Make your coverage a better fit for your current needs
All without worrying about being denied due to pre-existing conditions or recent health issues. But you can only do this in certain states—and only during a limited window tied to your birthday.
Which States Have the Birthday Rule?
As of now, the following states offer a birthday-based Medigap switching window. Each one has different timing rules:

California: 60-day window after your birthday

Oregon: 30 days before to 30 days after your birthday

Delaware: 30 days before to 30 days after your birthday (effective Jan 1, 2026)

Idaho: 63-day window after your birthday

Illinois: 45-day window around your birthday (ages 65–75)

Indiana: 60-day window from your birthday

Nevada: 60-day window starting from the first day of your birthday month

Louisiana: 63-day window around your birthday

Maryland: 30-day window after your birthday

Oklahoma: 60-day window from your birthday

Kentucky: 60-day window from your birthday

Rhode Island: 30-day window from your birthday (effective 2025)

Utah: 60-day window from your birthday (effective May 7, 2025)

Virginia: 60-day window from your birthday (effective July 1, 2025)

Wyoming: 63-day window after your birthday (effective June 4, 2025)

Missouri: 60-day window around your policy anniversary (anniversary rule)
If you live in one of these states, your birthday isn’t just a time to celebrate—it’s also your annual chance to review your Medicare Supplement plan and make changes without medical underwriting.
Note: Missouri’s Anniversary Rule isn’t technically a “birthday rule,” but it works in a very similar way. Instead of using your birthday month, your open enrollment window is based on your Medigap policy anniversary, allowing you to switch to the same plan type with a different carrier.
What You Can and Can’t Do
During your state’s Birthday Rule window, you can switch to a Medigap plan with the same or fewer benefits. For example, if you’re currently in Plan G, you could move to a different Plan G with another carrier—or to a Plan N.
What you can’t do is use the rule to upgrade. You can’t switch from Plan N to Plan G or from Plan G to Plan F unless you go through medical underwriting.
That’s why it’s important to understand your current plan and what alternatives are available—before your birthday window closes.
Why This Matters
As premiums rise over time, many people end up paying more for their Medicare Supplement plan than they need to. The Birthday Rule gives you a powerful tool to shop for better value without being penalized for your health status.
Even if you like your current coverage, it’s worth checking each year to see if another carrier offers the same benefits at a lower cost—or better service.
This kind of flexibility is rare in Medicare. If you live in a Birthday Rule state, you have an annual opportunity to take full advantage of it.
